Informative clause on the exercise of rights

The purpose of this document is to establish the procedure for the processing of applications regarding the exercising of rights on the personal data in the possession of SPET, Turismo de Tenerife, S.A.

In accordance with the rights conferred by the current regulations governing data protection, you may exercise the rights of access, rectification, limitation of treatment, deletion, portability and opposition to the processing of your personal data, as well as give your consent for the processing thereof by sending your request;

Anybody has the right to obtain confirmation as to whether SPET, Turismo de Tenerife, S.A. is or is not processing personal data that might concern them. All data subjects are entitled to access their personal data, to request the rectification of inaccurate data or, where appropriate, to request their deletion when, among other reasons, the data is no longer required to fulfil the purposes they were gathered for.
Under certain circumstances, and for reasons related to their particular situation, data subjects may request the limitation of or opposition to the processing of their data, in which case SPET, Turismo de Tenerife, S.A. will only hold them on file, for compelling legitimate reasons, to comply with any regulations currently in force imposed by the administration, or the lodging or defence of possible claims.

COSTS OF THE EXERCISE OF RIGHTS
The exercise of the rights shall be free for the data subject. In those cases in which manifestly unfounded or excessive requests are made, especially on a repetitive basis, SPET, Turismo de Tenerife, S.A. may charge a fee that compensates the administrative costs of dealing with the request or refuse to act (the fee will correspond to the cost of processing the application).

DEADLINES
SPET, Turismo de Tenerife, S.A. shall inform you about the actions derived from your request within a month (this may be extended by two further months in the case of especially complex requests, with this being previously notified).
Depending on the volume of data and information being processed, SPET, Turismo de Tenerife, S.A. may request that you specify the information referred to in your access request.

PROCEDURE DESCRIPTION
The exercise of rights must be carried out via a communication addressed to SPET, Turismo de Tenerife, S.A., which shall contain:
Name and surname of the data subject; photocopy of the document that proves the identity of the affected person and, where appropriate, of the person who represents him or her; as well as the document accrediting such representation.
Petition in which the request is specified.
Address for notification purposes, date and signature of the person making the request.
Documents accrediting the petition made, if appropriate.
In the event of the request being exercised by a legal representative: it shall be necessary to accredit this condition.
In the event of the request being exercised by a voluntary representative: a copy of his or her National ID Document or equivalent document and the representation conferred thereby shall be provided.

TELEPHONE request
Since these are extremely personal rights, this medium does not enable the accreditation of the person's identity. Therefore, this medium shall NOT be implemented.
You must make your request in writing (by email, postal mail or in person).

Request made IN PERSON
Please be informed that a reply or response is not necessary immediately or on the spot. This is because there are legal deadlines and the request must be processed according to the procedure described here.
The corresponding application document shall be provided attaching a photocopy of the valid document that identifies it. As well as the documents that accredit you as the legal or voluntary representative.
All documentation must be submitted to SPET, Turismo de Tenerife, S.A. REF: Protección de Datos, Avda. La Constitución, 12 - 38003 Santa Cruz de Tenerife, Spain.
We shall respond to the request within the legally established period.

Application made by POSTAL MAIL
Requests shall be sent to SPET, Turismo de Tenerife, S.A. REF: Protección de Datos, Avda. La Constitución, 12 - 38003 Santa Cruz de Tenerife, Spain. It shall be verified that it provides enough personal data to accredit the identity of the affected person or representative, if applicable, as well as a photocopy of the document that accredits his or her identity.
In the event that the request does not meet the requirements specified above, written communication shall be sent to request the formal correction of the request.

Application made by EMAIL
The requests shall be received via the email address: protecciondedatos@webtenerife.com and sufficient personal data to accredit the identity of the person making the request shall have to be provided.
If the application does not include the required elements due to a failure to observe formal requirements, SPET, Turismo de Tenerife, S.A. shall require the data subject to proceed with the correction by means of an e-mail sent to the address provided by the data subject.

Claims (Protection of rights)
If the applicant is of the opinion that he or she has not been properly able to exercise his or her rights, he or she may lodge a complaint with the Spanish Agency for Data Protection (AEPD) in order to initiate a protection of rights procedure.
This can only be done once the legally established deadlines have elapsed.
The claim must be addressed to the AEPD C / Jorge Juan, 6 • 28001 Madrid, Spain; website https://www.agpd.es accompanied by one or other of the following documents:
The refusal of the file manager to provide the information requested.
A copy of the request form stamped by the file manager.
Copy of the registered mail dispatch receipt or a copy of the request bearing the stamp of the post office.
Any other means of proof provided by the file manager accrediting receipt of the request.
